Terms of Service

The ground rules.

Last updated: October 15, 2026

These terms are an agreement between you and Baybreak. By creating an account or using the app or this website, you agree to them. Please read them along with our Privacy Policy.

Who can use Baybreak

You must be 18 or older and able to agree to these terms. Use your real identity: your real first name, a real photo of you, and social accounts that are actually yours. One account per person.

You're responsible for what happens on your account, so keep access to your email and sign-in accounts secure and tell us if you think someone else is using it.

What Baybreak is, and isn't

Baybreak is a place to find and list housing in San Francisco and to connect with the people behind it: sublets, rooms, roommates, lease takeovers, home exchanges, house and pet sitting, and community posts like moving sales.

Baybreak is not a party to any lease, sublease, rental, sale or sitting arrangement you make with someone you meet here. Any agreement is between you and them. We don't own, inspect or guarantee any listing, and we don't act as a landlord, broker or agent for anyone.

If you list a place

  • Only list places you have the right to rent or sublet. That includes getting your landlord's permission where your lease or the law requires it.
  • Be honest. Use real, current photos of the actual place, and accurate prices, fees and dates.
  • Follow fair housing laws. You may not discriminate based on race, color, religion, sex, gender identity or expression, sexual orientation, national origin, ancestry, disability, familial status, marital status, age, source of income, or any other characteristic protected by federal, California or San Francisco law.
  • The only preference allowed is a gender preference for shared living spaces, such as a room in a home where you'd share a kitchen or bathroom, and only where the law allows it.
  • Keep listings current. When a place is taken, mark it as taken or remove it.

Community agreements

Everyone agrees to these when they join.

  1. Be who you say you are. Real name, real photo, real accounts.
  2. Only list what you can offer. If it isn't yours to rent, don't post it.
  3. No money before a viewing. Never ask for, or send, a deposit or rent before an in-person viewing or a live video tour.
  4. Keep it inclusive. Treat everyone with respect, and follow fair housing laws.
  5. Update your listings ASAP. Take them down or mark them taken as soon as they're gone.
  6. Speak up. Report anything that feels off, so we can look into it.

What's not allowed

  • Scams, fake listings, or listing a place you don't control
  • Asking for a deposit, rent or any payment before a viewing
  • Pressuring someone to pay or talk outside Baybreak to get around our safety features
  • Harassment, threats, hate speech or unwanted sexual content
  • Spam, including mass messages and repeated unwanted contact
  • Fake accounts, impersonation, or using someone else's photos or social accounts
  • Scraping, crawling or copying the service or its data, or using it to build another product
  • Breaking the law, or trying to break or get around the app's security

Safety

Always see a place in person or on a live video tour before you pay anything. We review every new lister's first listing and check for common scam patterns, but we can't verify every listing or every person. Use your judgment, and see our safety tips.

Your content

You own what you post: photos, listings, profile details and messages. By posting, you give Baybreak a non-exclusive, worldwide, royalty-free license to host, store, display, resize and share that content within the service, only to run and improve Baybreak. This license ends when you delete the content or your account, except for copies other people already have, such as messages in their chats.

Only post content you have the right to share.

Moderation and removing accounts

We may review, hold, hide or remove listings, sales, messages or profiles that break these terms or put people at risk. We may suspend or remove accounts that do. When we can, we'll tell you why.

You can stop using Baybreak and delete your account at any time.

Community sales

Moving, estate and yard sales are between the buyer and the seller. Baybreak doesn't handle payments, inspect items or guarantee their condition, and isn't responsible for the sale.

Disclaimers and limits on liability

Baybreak is provided "as is" and "as available". We work hard to keep it running and safe, but we don't promise it will always be available, error-free, or that any listing, person or arrangement will work out.

To the extent the law allows, Baybreak isn't liable for indirect, incidental or consequential losses, or for anything that happens between you and another member, including a lease, sublease, rental, sitting arrangement or sale. Our total liability to you for any claim is limited to the greater of what you paid us in the 12 months before the claim, or $100.

Some places don't allow these limits, so they may not all apply to you. Nothing here limits rights you have that can't be waived by law.

If someone makes a claim against Baybreak because of something you posted or did in breach of these terms, you agree to cover the reasonable costs that follow.

Changes, law and contact

Changes. If we change these terms in a way that matters, we'll tell you in the app or by email before the change takes effect. If you keep using Baybreak after that, the new terms apply.

Law. These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Disputes will be handled in the state or federal courts in San Francisco County, California, unless the law where you live says otherwise.

Contact. Questions about these terms: [email protected]. Baybreak, San Francisco, California.
